Kroy Biermann Wants Primary Custody of His Kids, Says Kim Zolciak’s Home ‘Lacks Structure’

The drama between Kroy Biermann and Kim Zolciak is far from over — and now it’s getting even messier in court.

According to new legal docs out of Georgia, the former NFL star is asking a judge to make his house the primary residence for the four kids he shares with Kim. Right now, under their custody agreement, Kroy and Kim each keep two kids at a time — the older boys rotate together, and the younger twins (a boy and girl) rotate together every week.

But Kroy says this setup is hurting the kids’ mental health because they’re basically living two separate lives in two different homes. He’s now pushing for full custody to give them stability.

In his filing, Kroy’s legal team came with heavy accusations, claiming there’s a “noteworthy absence of structure and accountability” in Kim’s home. He alleges she often leaves the kids alone or in the care of others, picks them up early from school without reason, and doesn’t know enough about their educational needs — pointing out three of the children are struggling in school.

Kroy also accuses Kim of being emotionally and psychologically abusive, saying her behavior has been manipulative and harmful.

This isn’t the first time family tensions have boiled over — earlier this summer, their daughter Kaia Rose was sent to stay with Kroy’s relatives in Montana, a move Kroy says was necessary because of her strained relationship with Kim.

Kim, however, isn’t letting these claims slide. Her rep fired back, calling Kroy’s filing “false, misleading, and deeply hurtful”, insisting she’s always been a devoted and attentive mother. The rep added that Kim provides structure, love, and emotional support — and accused Kroy of filing unsealed court documents just to sway public opinion.

For now, it’s another round in their ongoing custody battle, with both sides standing firm — and their kids caught in the middle.
