Diddy is making another push for freedom before his October 3rd sentencing — and this time, his legal team is coming in hot, claiming he’s being unfairly punished for living a “swinger lifestyle.”

In newly filed court documents, obtained by TMZ, Diddy’s lawyers argue that he’s the only man in America behind bars for hiring male sex workers to sleep with his longtime girlfriend. They stress that the men involved were all consenting adults, and that the encounters were part of a consensual threesome lifestyle between Diddy, Cassie, and another woman, referred to as “Jane.”

His legal team — led by Marc Agnifilo and Teny Geragos — says Diddy’s conviction under the Mann Act (which dates back to 1910) is outdated, especially in today’s more open-minded society when it comes to sex and adult relationships. They note that most people convicted under the same charges are released before sentencing, and Diddy should be treated no differently.

The motion lays out a $50 million bail package, secured by Diddy’s Florida estate and backed by three financially responsible individuals. He’s offering to stay locked down at his Miami home, be monitored by Pretrial Services, give up his passport, and even go through mental health and substance abuse treatment if needed. Home detention? He’s open to that too.

Diddy is currently in custody after being convicted of prostitution-related charges, although he beat the more serious racketeering and sex trafficking counts. He was denied bail after the verdict, with the judge calling him a danger to the community due to past violence.

His lawyers address that head-on, claiming the only violent act since 2018 was a recent altercation with “Jane” — which they say she started. They acknowledge the Cassie hotel beating video shown at trial but argue that he’s changed since then.

Now, the ball’s in the judge’s court. Prosecutors have already made it clear they don’t want Diddy walking free before sentencing… but with this new argument, the pressure just got heavier.
