Todd Tucker Challenges Prenup and Wants FULL Custody! 😳 Says Kids Are With Him While Kandi Works Out of State!

The Kandi Burruss vs. Todd Tucker divorce saga just kicked up several levels — because Todd is officially demanding primary custody of their children, according to new court docs obtained by Us Weekly.

On November 26, Tucker filed his response to Kandi’s divorce petition, claiming that their kids — Ace (8) and Blaze (5) — are currently living with him in Georgia while Kandi handles multiple out-of-state work obligations. According to Tucker, this schedule will keep Kandi away “for the next several months,” which is why he says the children should stay primarily with him.

Even with the strong request, Tucker’s filing took a respectful tone. He emphasized that he and Kandi have been cooperatively trying to resolve things, and he praised her openly as a “loving and capable parent.”

Still, in the event they can’t reach an agreement, Todd is pushing for:

  • Primary physical custody
  • Joint legal custody
  • Final decision-making authority
    with Kandi getting “meaningful access.”

Prenup Drama Unfolds

Todd also raised eyebrows by challenging the prenup he signed before their 2014 wedding.

He claims Kandi’s team dropped the final version on him right before the ceremony — without his lawyers present, even though his attorneys had previously been involved. Todd’s filing says the circumstances bring “substantial questions” about whether the prenup should even be enforceable.

If the agreement gets tossed, Todd is prepared to seek alimony and a fair split of all marital assets, from property to investments.

Kandi’s Side of the Story

Kandi filed for divorce on November 21, calling the marriage “irretrievably broken” with no hope for reconciliation.

She is asking the court to:

  • Enforce the prenup
  • Grant joint custody
  • Divide debts according to the prenup
  • Determine child support
Kandi publicly announced the split after 11 years of marriage, citing peace, growth, and co-parenting goals. She admitted the breakup had been “brewing for a while.”

With conflicting custody requests, prenup disputes, and assets on the table, this divorce is shaping up to be one of the messiest breakups Bravo fans have ever witnessed.
